A personal injury case stems from an accident that was caused by the actions or inactions of a person or party. When someone is injured in such an accident they may engage the services of a personal injury attorney to represent them in the legal proceedings meant to seek financial restitution on their behalf.

A personal injury attorney does a number of things for their client. First and foremost they determine the validity of the case and if liability is evident on the part of the defendant. Going forward, should the personal injury attorney take on the case they will work with their client to collect the evidence that will establish liability in a court of law. In other words, a personal injury attorney defines the claimant’s case – helping to present the evidence in such a way that liability is just as clear to a judge and jury as it is to the injured party.

However, before a case ever sees the light of a courtroom, a personal injury attorney will work with the attorney for the opposition to attempt to reach an out of court settlement that will save everyone the time and expense of going to court. If liability is clear through the case constructed by the personal injury attorney the opposing attorney may decide that it is less expensive for their client to simply settle on an amount of money to be paid to the injured person, rather than taking their chances in court.
